Terms of Use
TERMS OF USE for PowerUP mobile application (PowerUP LLC) These terms of use (“Terms of Use” or “Terms”) constitute an offer for users of the mobile application “PowerUP” (“App”) to use the App. The Terms establish general rules and conditions for the use of the App and services.
Clause 1
Terms and Definitions
1.1 “App” and “PowerUP” mean the PowerUP mobile application for iOS and Android operating systems.
1.2 “Company” means PowerUP Solutions PTE. LTD. (Singapore).
1.3 “Device” means power banks available for Users’ use.
1.4 “Partner” means a dedicated legal entity that provides operational support to the Company in a country/region and supplies equipment and infrastructure for the Services.
1.5 “Services” refers to the set of actions resulting in the user’s usage of a Device.
1.6 “Stations” means docking stations with slots for charging Devices.
1.7 “User” means an individual who has downloaded and logged into the App.
1.8 “Website” means the Company’s official website https://www.wepowerup.io providing information about the Services and the App.
Clause 2
Personal Data collected by the Company
2.1 The Company provides Users with software facilitating Services, including locating Devices, renting them (including payment processing), and improving Service quality.
2.2 These Terms do not govern the rental relationship itself. Rental rules are outlined separately, with the Partner acting as the rental counterparty.
2.3 The App enables Users to express potential demand for Services at no cost, including Device search and rental.
2.4 By using the App, the User consents to the Company collecting, analyzing, and storing information about the User’s device and App functionality. If such data is classified as personal, it is processed under the Company’s privacy policy.
2.5 The App is provided free of charge. Users can download it from App Store (iOS) or Play Market (Android).
Clause 3
App Usage
3.1 The Services are based on the App, Devices, and Stations.
3.2 The App is central to user interaction; Devices and Stations are maintained by the Partner.
3.3 Registration is required to use the App, with methods shown on the main screen.
3.3.1 Registration requires a phone number or alternate authentication system.
3.3.2 By registering with a phone number, the User agrees to receive an SMS with a confirmation code, which must be entered. Incorrect numbers will result in refusal to register.
3.4 Upon registration, the User receives a unique ID for authentication and legal operations.
3.5 Initially, functionality is limited; to rent a Device, the User must add and verify payment details.
3.6 The App is for personal, non-commercial use only.
3.7 The User is responsible for all actions in their account.
3.8 The User may not:
3.8.1 Modify, decompile, decrypt, or interfere with the App code.
3.8.2 Use the App in a way contrary to the Terms or standard practices.
3.9 The App may be used worldwide where available.
3.10 The App uses free, public-domain maps. The Company does not own map copyrights.
3.11 The Company holds exclusive rights to the App. These Terms do not transfer those rights.
3.12 App Stores Compliance:
a) Distribution and Installation: iOS users must use the Apple App Store; Android users must use Google Play.
b) Platform-Specific Requirements:
iOS: Users accept Apple’s EULA; in-app payments go through Apple; Apple is a third-party beneficiary.
Android: Users accept Google’s Terms; payments go through Google Play; Google is a third-party beneficiary.
c) Updates and Compatibility:
Users must keep the App updated.
Updates may be required for continued use.
Minimum requirements: iOS 13.0+; Android 8.0+.
d) Store-Specific Disclaimers: Apple and Google are not responsible for App performance, support, warranty, or legal claims.
e) Reviews: Users can post reviews. The Company may respond. Misleading reviews may face legal consequences.
f) Intellectual Property: Store trademarks belong to respective owners. Users must not circumvent App distribution methods.
Clause 4
Tariffs and Payments
4.1 Tariffs are shown in the App in local currency and may change without notice. The tariff displayed after scanning the Device’s QR-code applies for the entire rental period.
4.2 Charges begin when the User takes the Device from a Station. Charges continue hourly until return.
4.3 Payments cover both rental fees and service facilitation.
4.4 The Company may require a refundable deposit up to $10 depending on local tariffs.
4.4.1 The deposit is refunded unless outstanding charges apply.
4.4.2 If payment is not completed due to the User’s fault, the outstanding balance is deducted from the deposit.
4.5 If the Device is returned with damage due to misuse (not wear or standard charging), the Company may deduct $100 from the User’s card.
4.6 Payment Processing:
a) All payments are in AED via authorized providers.
b) Visa and MasterCard are accepted.
c) All prices include 5% VAT.
d) Refunds are made via the original method.
e) The Company does not store card details.
4.7 Compliance:
a) No services for OFAC-sanctioned countries.
b) UAE law governs all transactions.
c) Disputes are under UAE jurisdiction.
d) Operations follow UAE Central Bank rules.
4.8 Consumer Protection:
a) Users receive receipts.
b) Prices include VAT.
c) Complaints may be filed through official channels.
d) Consumer rights are protected under UAE law.
Clause 5
Services
5.1 Devices are available only from the PowerUP Station network; locations are shown in the App.
5.2 Rental steps:
5.2.1 Open the App.
5.2.2 Tap the QR-code icon.
5.2.3 Scan the QR-code or enter the Station number.
5.2.4 Confirm the match and press “Correct” to unlock a Device.
5.3 Paid usage starts when the “Get Charged” button is pressed and continues until the Device is returned and confirmed in the App.
5.4 Upon receiving a Device, the User must inspect it within 5 minutes. If issues are found, the Device must be returned immediately. Otherwise, the Device is considered usable, and the User may be liable for damage.
5.5 If the Device number does not match, the User must contact support.
5.6 Users may rent up to 2 Devices at a time.
5.7 The Device must be returned to an accessible Station.
5.8 If a Station cannot accept the return, another Station must be used, and charges continue until drop-off.
5.9 Contact support if problems arise during return.
5.10 Returning the Device to a non-PowerUP Station does not count as a valid return.
Clause 6
Liability
6.1 The App is provided “as is.” The Company is not liable for installation, updates, support, or performance issues, including conflicts with other software.
6.2 The Company’s liability per User is limited to $100.
6.3 The Company is not liable for lost profits unless required by mandatory law.
6.4 The User is fully liable for any consequences of sharing the Device.
6.5 Physical damage to the Device may result in fines in addition to the damage fee.
6.6 Illness, travel, or other reasons that prevent return are not grounds for non-payment. However, the Company may consider documented cases.
Clause 7
Final Provisions
7.1 These Terms remain binding until the User deletes their account and notifies the Company.
7.2 The Company may update the Terms at its discretion and notify Users via e-mail. Continued use of the App implies acceptance of new Terms.
